Sales Terms & Conditions of Sale

1. PRICES

All bid prices “hammer prices” (means the price at which a lot is knocked down/sold to the purchaser) will be subject to a buyer’s premium, of 22.5% of the hammer price (GST inclusive). The buyer’s premium price is added to your successful bid and the two together make up your purchase price. Eg. A hammer price of $100 would total $122.5 (inclusive of the buyer premium).

2. PAYMENT METHODS

Auction sales are strictly by bank deposit, cash, eftpos or credit card (Mastercard & Visa and American Express available, please note the bank may charge additional fees). Payment by cheque is not available. All sales are final at the fall of the auctioneer’s hammer/online sale declaration by auctioneer.

3. PURCHASES

At the falling of the hammer/online sale declaration by the auctioneer, the highest bidder will have purchased the offered lot. The purchase is subject to all the terms and conditions set forth herein. The purchaser assumes full responsibility thereof. All items purchased must be paid for and collected on the day for in person sales unless other arrangement have been made with auctioneer. Online sales invoices must be paid within 24 hours of receipt of invoice.

4. WITHDRAWALS

We reserve the right to withdraw any property prior to sale, to pass items or make changes prior to the auction. Any changes made will be included on the day of the auction as an amendment.

5. SUCCESSFUL PURCHASERS

All absentee and postal bidders will be notified by email or phone where possible. All successful purchasers are required to pay the invoice amount, and will be notified on the cost of packaging, freight and insurance on successful bids if required and charged at appropriate rates. Please allow 7-10 working days for delivery.

6. GST

GST is included in the bidding price.

7. RETURNS & REFUNDS

All property offered for sale is as is, where is. Tuckerbox Auctions Pty Ltd does not guarantee or make warranties on any lot sold except for requirements of clear ownership under Australian Consumer Law. Descriptions in the catalogue are based on best opinions. They are written as a guide to potential bidders. We strongly recommend you view any item personally or seek further information from auctioneers if required prior to bidding.

Under the conditions of Australian Consumer Law auctions are not required to provide refunds for items purchased at auction so please do your due diligence and bid carefully. If there are any issues with items purchased from auction not matching the description provided from the auction catalogue (eg. A ruby ring is determined to be spinel, gold is 9ct not 18ct as described etc) please contact us within 21 days of the sale date to discuss a refund. Once the 21-day period is over the vendor will have been paid and it will not be possible to provide a refund for any circumstances.

Refunds will not be offered (even within the 21-day period) for the following reasons:

  • You have changed your mind,
  • You have overspent,
  • The jewellery items don’t suit or fit,
  • You have not able to on-sell items purchased as hoped,
  • You took items to another valuer, and received a differing opinion as to the insurance value,
  • You received any disparaging verbal information about an auction item provided from a competitor in the field.

No employee of Tuckerbox Auctions Pty Ltd is authorised to make any representation of warranty, oral or written with respect to any property. If you are not sure of any item (even after talking with auction staff) DO NOT BID.

Many jewellery items come with certificates from  gemmologists/valuers, or laboratories. This is to increase confidence that items are described correctly (eg. Gold is 18ct, the stone is a diamond or ruby etc). Some certificates provide estimated valuations for insurance purposes only. These are the opinions of the valuer at the time of assessing the items. These valuers are independent of Tuckerbox Auctions Pty Ltd. The valuation amount has no bearing on the auction value of an item. Any questions regarding the valuation should be directed to the issuing valuer (refer to contact details on the certificate) as Tuckerbox Auctions Pty Ltd. have no association with the valuer or valuation amount contained in the valuation.

8. DEFINITION OF TERMS

  • Circa: Means approximate date of manufacture.
  • Style:(eg. Deco Style ring) means that we are unable to authenticate items and have thus used the word style, with goods priced accordingly.
  • We do stress there are no guarantees or warranties so it important that purchasers do their own research when considering bidding prior to auction.

9. FAILURE TO PAY

Failure to pay for an item that has been won by a purchaser in accordance with the aforementioned Terms and Conditions may result in late payment fees or storage charges. Non-payment of won items will result in the purchaser being barred from participating in future auctions, with appropriate feedback of non-payment left on publicly accessible auction platforms where appropriate.

10. ACCEPTANCE OF TERMS 

Acceptance of a bidder card/online registration in conjunction with a recognised bid constitutes acceptance of the Terms & Conditions of Sale.
